Terms of Service

1. The Service

DockPass helps companies verify the drivers who collect shipments from their warehouses. Companies create shipments and Handling IDs; drivers verify their identity; and company staff use single-use credentials and checkpoints to control each pickup. Features may change as we improve the Service.

2. Accounts

• Company administrators are responsible for all accounts they create and for their staff's use of the Service.
• You must provide accurate information and keep passwords confidential. Tell us promptly about any unauthorized use.
• You must be at least 18 years old and able to form a binding contract.

3. Customer responsibilities

• Create shipments and Handling IDs only for genuine shipments, and share Handling IDs only with the assigned carrier.
• Obtain any notices and consents required by law from drivers and staff, including for identity photos and biometric checks.
• Make your own release decisions. DockPass provides verification signals and records; it does not take custody of freight.
• Comply with all laws that apply to your use of the Service, including privacy, employment and transportation laws.

4. Driver terms

Drivers use the Service to verify their identity for a specific pickup. You agree to provide your own genuine identity documents and a live photo of yourself, and not to share, copy or transfer your pickup credential. Providing false identity information or attempting to collect a shipment you are not authorized to collect may be reported to the shipping company and to authorities.

5. Acceptable use

You must not:

• Attempt to guess, brute-force or reuse Handling IDs or pickup credentials.
• Upload forged, altered or someone else's identity documents or photos.
• Probe, scan or test the vulnerability of the Service without our written permission, or interfere with its operation.
• Reverse engineer, resell or provide the Service to third parties except as permitted by your plan.
• Use the Service for any unlawful, fraudulent or harmful purpose.

6. Fees and trials

Paid plans are billed in advance on a monthly basis at the prices shown on our pricing page or in your order. Free trials end automatically unless you choose a paid plan. Fees are non-refundable except where required by law. We may change prices with at least 30 days' notice, effective from your next billing period. Unpaid accounts may be suspended.

7. Customer data

You keep all rights to the data you and your staff and drivers submit (“Customer Data”). You grant us the rights needed to host, process and display Customer Data to provide and secure the Service. We handle personal information as described in our Privacy Policy. You may export your data and ask us to delete it when you close your account.

8. Third-party services

Identity checks are performed by third-party verification providers, and the Service runs on third-party infrastructure. We are not responsible for services we do not control, but we choose providers carefully and require them to protect your data.

9. Intellectual property

DockPass and its software, design and content are owned by us and our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. If you send us feedback, we may use it without obligation to you.

10. Disclaimers

The Service is provided “as is” and “as available”. Identity verification reduces risk but cannot guarantee that every fraudulent attempt will be detected, and the Service does not replace your own security procedures. To the extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

11. Limitation of liability

To the extent permitted by law, DockPass will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goods, including losses from theft of cargo. Our total liability for any claim relating to the Service is limited to the fees you paid us in the 12 months before the claim.

12. Indemnity

You will defend and indemnify DockPass against third-party claims arising from your Customer Data, your breach of these Terms, or your violation of law, including failure to obtain required consents from drivers or staff.

13. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or if your use creates a security risk. Sections that by their nature should survive termination (including fees owed, data, disclaimers, liability and indemnity) will survive.

14. Changes to these Terms

We may update these Terms from time to time. We will post the new version here and, for material changes, notify account administrators at least 30 days in advance. Continuing to use the Service after changes take effect means you accept them.

15. General

These Terms are the entire agreement between you and DockPass about the Service, unless you have a signed agreement with us, which then prevails. If any provision is unenforceable, the rest remains in effect. You may not assign these Terms without our consent. Our failure to enforce a provision is not a waiver.
